Terms and Conditions for SwiftyLaunch

Welcome to SwiftyLaunch. These Terms of Service ("Terms") govern your ("User", "you") access to and use of the SwiftyLaunch website (https://swiftylaun.ch) ("Website") and of the SwiftyLaunch macOS application ("SwiftyLaunch", "Application"), owned and operated by smallwhite Media e.U ("Company", "we", "us", or "our"). By accessing or using the Website, the Application or other Services, you agree to be bound by these Terms. If you do not agree to these Terms, you are not permitted to use our services.

1. License and Use
Upon purchasing a license for SwiftyLaunch, a macOS Application developed by us, you are granted a non-exclusive, non-transferable license to use SwiftyLaunch for generating SwiftUI iOS and iPadOS code boilerplate. The generated code may be used to develop iOS applications. You own the code you write, but you may not resell any generated code or the SwiftyLaunch Application itself. Any modification, tinkering, or unauthorized use of SwiftyLaunch is strictly prohibited.

2. Ownership and Restrictions
You retain ownership of the applications you create using SwiftyLaunch. However, the SwiftyLaunch Application and all its components, including the license, are owned by smallwhite Media e.U. Reselling the SwiftyLaunch Application or its generated code is not allowed.

3. Refunds
You may request a full refund within 14 days of purchase if you are not satisfied with the SwiftyLaunch Application.

4. Limitation of Liability
The SwiftyLaunch Application is provided "as is", without warranty of any kind. We do not guarantee that the code generated will be free from errors or bugs, and we shall not be liable for any damages resulting from the use of the Application. Additionally, we are not responsible for any illegal activities conducted with the aid of SwiftyLaunch.

5. Trademarks
macOS, iOS, Swift, and SwiftUI are trademarks of Apple Inc. Our use of these trademarks does not imply any affiliation with or endorsement by Apple.

6. User Data
We collect personal information such as your name, email address, and payment information, as well as general app usage statistics. For details on how we handle your data, please visit our Privacy Policy at https://swiftylaun.ch/privacy-policy.

7. Non-Personal Data Collection
We use cookies to collect non-personal information to enhance your experience on our Website.

8. Payment Processing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns

9. Governing Law
These Terms shall be governed by the laws of Austria, without regard to its conflict of law provisions.

10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. You will be notified of any changes through the email address you have provided us.
